Phnom Penh (FN), Jun. 26 – Cambodian prime minister Hun Sen urged to pay high attention to five important points in order to improve the quality of a fair and just trial in accordance with the law, speaking on Monday (June 26) during an official inauguration of a new building of the Court of Justice of the Ministry of Justice.

The five points are as follow:

1. Resolve disputes as soon as possible, resolve the bottleneck of appeals, and help resolve differences between the parties to enhance national unity, harmony and better social order.

2. Encourage the role of judges to be more active in resolving disputes, mediation, conciliation and settlement of disputes between the parties as soon as possible.

3. The Ministry of Justice needs to establish a clear legal framework for the management of mediation and dispute resolution, which is a new priority in the framework of dispute resolution reform in Cambodia.

4. The Trial Chamber and the Prosecutor's Office at all levels must continue their efforts to carry out their work within their jurisdiction with high quality and high professional ethics, especially to strengthen the effectiveness of law enforcement, the effectiveness of action on cases and the improvement of quality of its decision to improve the efficiency of justice services and the quality of justice for the people in accordance with the direction of legal reform and the justice system of the Royal Government.

5. The Ministry of Justice must expedite the establishment of a legal framework as well as infrastructure to expedite the operation of commercial and labor courts in a quality, transparent and credible manner to increase trust in investment and business in Cambodia and to further promote the drafting of the Law on the egistry, the Bailiff Law, the Law on the Notary and other relevant laws as soon as possible, which is the legal basis for managing and promoting the legal profession in a transparent and current and future manner.

On that occasion, Samdech also encouraged the authorities, judicial officials as well as the courts at all levels to use the mediation mechanism between parties to the best of their ability to resolve in a win-win manner in civil cases.
